Protection against unfair standard terms in contracts made with traders
This is available to individual consumers who have entered into a contract with a Company or Business, and is directed towards providing compensation for a loss where there is inequality in bargaining power, and unfair terms were hidden in the small print.
Action will be taken on behalf of the consumer by the Office of Fair Trading, and if a contract term is considered to be unfair, then the Office of Fair Trading should be your first contact. They will try to negotiate an amendment to the term in the contract, and if necessary make an application to the Court. Any term found to be unfair will not have to be complied with.
